Budget and Warrant Hearing Tomorrow Night February 5th.

The public hearing is at Town Hall beginning at 7pm. Most of the information is available here on the Town website.The latest iteration of the Town Warrant ( as of February 3rd)  includes the usual list of petitioned "hearts and flowers" articles.
There are two other petitioned articles of note. One is the article to eliminate the position of Town Administrator:
"The undersigned hereby petition the Town of Moultonborough to eliminate the position of Town Administrator and to transfer the duties of the position to the elected Board of Selectmen. For transition purposes only, this change shall take effect on May 1, 2015. Nothing contained herein shall authorize the Board of Selectmen to increase the salary of the Town Administrator prior to May 1, 2015, nor to provide severance payments and/or to amend the existing agreement (if any) with the incumbent Town Administrator."
The other seeks to raise and appropriate $85,000 "..for engineering, acquisition of rights of way or easements, legal costs, preparation of plans and specifications and bidding for the purpose of sidewalk construction in Moultonborough Village."  As per the draft warrant, the petitioner's seek to provide a sidewalk along route 25 within the right of way as possible with a cross walk located halfway between the library and the Central School. Hopefully the petitioner's will be present to provide more details.

With that agenda, will the fun begin on PETITIONED WARRANT articles, or be saved for another day?

page 44 #4:

As a reminder, even if a petitioned warrant article is illegal", the NH Municipal Association (you know ... a whole bunch of lawyers)advises to place the article on the warrant.

One lawyer's opinion is just that ...an opinion. God forbid it is a biased opinion.

No need for litigation, in a lot of cases. Just a ruling from the Superior court on ... "what is ... is" is all that is necessary.

If a valid petitioned warrant article is not placed not the warrant, besides being a criminal offense, it is almost a certainty, a lawsuit will be forthcoming.
