Moultonboro Planning Board February 25th, 2015

The discussion about the NHEC solar array begins at 24 minutes in. The NHEC came to the BoS a few months back about a solar array at the landfill behind the transfer station. The BoS asked for some additional information, but the co-op decided to look elsewhere.

From the BoS minutes:

"NHEC is member owned and is looking for ways to serve members. They are required to provide a specific amount of energy by solar PV power."

"Mr. Lemay said that the megawatt, again a small amount of electricity, would likely stay in Town."

"Mr. Cormier asked what’s in it for the consumer or can it be a business enticement. Mr. Lemay replied that it is a way for members to participate by purchasing output which turns into money on their bill, and is a way to pre-buy electricity"

So ... no ... on dump site!
So ... other site ... on NHECOOP property, their property, not town property.

Private property rights v. government intrusion.

Maybe the lawyers should get involved, now!

Bruce is very knowledgeable, but is not a lawyer. It is illegal for anybody, but an attorney, to give legal advice (state statute).

Easements ... deeds ... landlocked property ... property rights ... site permits ... case law ...

Those that think they know, but are wrong ... or those that do know, ... or maybe a court decides.

A town planner can give an opinion ... only, on legal matters, as any citizen (U.S. Constitution).

Never heard "view tax" mentioned!

However,no weasel action by any entity for MoBo.
